These Terms of Service (“Terms”) govern your access to and use of the website atelierrender.com, 3D technical design tools, clothing development solutions, online courses, ebooks, mentorship programs, and any related services (collectively, the “Services”) provided by Atelier Render, a digital studio based in Santiago, Chile (“we”, “us”, or “our”).

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

1. Our Services

Atelier Render provides digital solutions including:

3D technical design software/tools for clothing development and realistic rendering.
Online courses, ebooks, and mentorship programs related to clothing design and 3D technical workflows.
Associated support, resources, and digital content.

All our Services are delivered digitally. No physical products are shipped unless explicitly stated.

2. User Accounts

To access certain Services (e.g., courses, mentorship, or design tools), you may need to create an account. You agree to:

Provide accurate, current, and complete information.
Maintain the confidentiality of your account credentials.
Notify us immediately of any unauthorized use of your account.

You are responsible for all activities that occur under your account.

3. Intellectual Property

Our Content and Tools: All materials provided by Atelier Render, including the website, 3D design tools, software interfaces, courses, ebooks, videos, templates, and any other content, are owned by Atelier Render or our licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works without our prior written permission.

Your Creations (User Content):

You retain full ownership of the 3D models, patterns, designs, projects, and other creative work you create or upload using our Services (“Your Designs”).
By using our Services, you grant us a limited, non-exclusive, royalty-free license to host, display, process, and render Your Designs solely as necessary to provide the Services (e.g., rendering your models or providing mentorship feedback).
We do not claim any ownership rights over Your Designs.

Course and Mentorship Materials: Purchased courses, ebooks, and mentorship content are licensed to you for personal, non-commercial use only. You may not share, resell, redistribute, record, or use the materials for teaching others without our explicit written permission.

4. Licenses and Restrictions

Design Tools: Access to our 3D tools is granted as a limited, revocable, non-transferable license for the duration of your subscription or purchase. You may not reverse engineer, decompile, or attempt to extract source code.
Courses & Ebooks: Digital products are delivered as non-transferable licenses. Lifetime access (when offered) means access for as long as the course is supported by us.
You agree not to use our Services for any unlawful purpose or in any way that could damage, disable, or impair our systems.

5. Payments and Refunds

All prices are in [USD / CLP / specify currency] and include applicable taxes unless stated otherwise.
Payments are processed securely through third-party providers (e.g., [Stripe, Mercado Pago, Webpay, etc.]).
We reserve the right to change prices at any time, with changes applying to future purchases.
Refund Policy: Due to the digital nature of our products (instant access to courses, ebooks, and design tools), all sales are generally final and non-refundable. Exceptions may be made at our sole discretion (e.g., technical issues preventing access). Requests must be made within 7 days of purchase with a valid reason. Mentorship sessions are non-refundable once scheduled or started.

6. Termination

We may suspend or terminate your access to the Services at any time, with or without notice, for violation of these Terms, non-payment, or other conduct that we reasonably believe harms our business or other users.

You may cancel your account at any time by contacting us. Upon termination, your right to use the Services ceases immediately, but your ownership of Your Designs remains with you.

7. Disclaimers and Limitation of Liability

Our Services are provided “as is” and “as available” without warranties of any kind, express or implied.

We do not guarantee that our 3D tools will be error-free, uninterrupted, or compatible with all devices/software. Results depend on your skills, input data, and hardware.

To the maximum extent permitted by Chilean law:

Atelier Render shall not be liable for any indirect, incidental, special, consequential, or punitive damages.
Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

8. Indemnification

You agree to indemnify and hold harmless Atelier Render, its owners, and team from any claims, losses, or damages arising from your use of the Services, your violation of these Terms, or infringement of third-party rights (including intellectual property).

9. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Republic of Chile. Any disputes arising from these Terms or your use of the Services shall be resolved exclusively in the competent courts of Santiago, Chile.

10. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the new version on our website with an updated “Last Updated” date. Continued use of our Services after changes constitutes your acceptance of the revised Terms.
